NewsReader Online Licensing, Terms and Conditions
1. Subscription
A license to NewsReader Online allows you to use the NRO System for PDF’s provided payment is made after each use. Purchasing a license automatically gives you the right to publish your material on the internet using the NRO System. The hosting fee covers your total portfolio of converted publications as a unique customer. When the hosting subscription expires the customer will be charged at our published hosting by volume pricing guide. See Prices. By purchasing a NewsReader Online license the customer automatically accepts the cancellation of any right to annul as soon as NewsReader Online has initiated the production of the order.
2. Licence
Purchasing a licence via NewsReader Online gives the right to upload and convert any number of publications or editions under our accepted and agreed upon pricing structure shown on our web site. The licensee agrees to the "pricing section" as shown on the site and terms as indicated.
3. Hosting of Publications and Archives
The customer will be invoiced each EOM for hosting and other related incurred costs according to our pricing section guideline.
3.1
NewsReader Online accepts no responsibility for the uploaded material. If any material contravenes copyright rules, the law, is offensive or for other reasons found unsuitable, it will be deleted and the customer informed. Any licensing and or fees will continue to be due and there will be no refunds on submissions of this kind.
3.2
If a publication puts such a load on the servers that the speed is affected, NewsReader Online reserves the right to remove the relevant publication or invoice the customer for the extraordinary operating cost and move to a dedicated server. This shall come into force if NewsReader Online' traffic costs for the individual publication exceed either normal or published figures.
4. Operational reliability
There is full operational reliability in line with other hosting services, but the server will at times be down for short periods in connection with e.g. updates or unforeseen circumstances. NewsReader Online will of course do its best to ensure that the publications always function in an optimum manner. NewsReader Online accepts no responsibility for up-time and thus cannot be held responsible for any down-time resulting from within or beyond our control.
5. Incorrect uploads
The user is responsible for correct uploading. The website contains detailed guidelines and NewsReader Online therefore shall not be held liable for errors and omissions in the publications. Refunds or financial restoration will not be refunded in connection with incorrect uploads. In the case of errors in NewsReader Online’ system, NRO will make good on reparations only in fixes and restoration, not including financial.
The customer’s use of NewsReader Online is in every respect the customer’s own responsibility. NewsReader Online accepts no responsibility for the content, including the correctness, legality, quality, etc. of the information received or provided by the customer via the Internet. NewsReader Online thus shall not be liable for loss – either direct or indirect, infringement of incorporeal rights or other circumstances that arise as a result of the use of information found on the Internet. NewsReader Online likewise shall not be liable for loss as a result of lack of access to services or information on the Internet, regardless of the reason for this lack of access. NewsReader Online accepts no responsibility for the loss of data of any kind, including loss or damage of installed software, etc. NewsReader Online furthermore accepts no responsibility for unauthorised access to customer data or systems or damage arising as a result. The customer shall be responsible for any costs arising in relation to the ordering of services via the Internet and the use of Internet payment systems. The inital signup license is for a minimum one year commitment.
Third party faults and force majeure: In addition to the above, NewsReader Online shall never be liable for interruptions, interferences, faults, damage, etc. due to circumstances beyond NewsReader Online' control, including lightning strike, flooding, fire, strike, war, acts of terrorism, stoppage or lockout (also if these involve NewsReader Online' own employees), Internet overload, faults in other organisations’ network, third party faults, system breakdown, other force majeure incidents, etc.
7. Cancellation
Either party may cancel the agreement entered with immediate effect. None of the payment made will be refunded and all monies owing will be due. Either party may cancel the agreement with immediate effect without giving any reason. NewsReader Online will process a customer cancellation as quickly as possible given other work commitments.
8. Downtime
NewsReader Online shall not be liable for downtime or any errors or omissions. NewsReader Online disclaims any liability on the same terms as those applying to uploaded publications.
9.Terms of Payment
NewsReader Online provides the lowest and most affordabe rates in the industry with very low markup for our time and costs. Discounts for immediate payment are built into our pricing structure. There is no margin for financing. All payments are due at receipt of invoice. Invoices are emailed to the email address on signup at the end of each month. Payment options are "direct deposit, PayPal, credit card via PayPal only, or check". Receipt of payment (including checks) is expected no later than the 15th of the month following. If payment is not received by the 30th, customer’s publication will be sidelined and unavailable for viewing until payment has been completed.
